As the FMA (and likely other agencies) proceed with legal proceedings against the various Duval legal entities, and Kenyon and Charlotte Clarke, we now hear that the Clarke’s need legal aid, and as such they’ve made an application.
We find this perplexing… Kenyon Clarke is on the record via his now closed Instagram account saying he’s worth $400,000,000.00, and building a $1,000,000,000.00 business.
Kenyon Clarke via his social media accounts was particularly active promoting his Fugazi to raise cash from hapless investors.
As we know Duval was placed in Statutory Management by order of the High Court on application of the FMA.
PWCs initial reports suggest debts of around $237,000,000.00
A quick “back of the envelope” calculation would suggest Mr Clarke’s wealth less debt sees him still making the NBR Rich List this year, so why the need for legal aid? (In an English twat laugh haw haw haw)
We contacted a lawyer who said they were one of about 150 lawyers who worked in the area of legal aid, and they had this to say…
“ Good grief. Can’t believe the Clarke’s are applying for civil legal aid. I am one of the 150 or so remaining civil legal aid providers, and it is bloody hard for any one of us to take on legal aid work as we are run off our feet and the admin the legal services agency requires of us is crippling”
They went on to say…
“And for civil legal aid, the lawyer has to certify prospects of success to get a grant. So here, the lawyer would need to say hand on heart that the Clarke’s have a reasonable prospect of defending the FMA’s orders, which is bonkers”.
Then again maybe it’s an application for using legal aid for criminal charges that we hear through sources are close to being formally laid.
First it was the investors to feel the pain, now it’s the tax payers turn.
