The Questions Ray White Epsom, David Subritsky and Richard Thode Refuse To Answer 

Last week we published our first article in what will be a series about what we believe is the misuse of the www.homes.co.nz website to alter a properties value mid campaign without the Vendors permission. 

Earlier this week this site was sent a threatening legal letter from Kennedys Law telling us we had until 5pm on Wednesday 26 August 2026 to remove our initial story, whilst they ignored and refused to reply to our small list of questions. 
 
The legal letter from Kennedys demanded our compliance, but what was most concerning was the claim (lie) they made that their clients were still engaging with the Vendors and that “matters were on-going”. What Matters are those? David Subritzky carried out his own ‘internal investigation’ and advised the Vendors there was nothing to see here, despite the copies of emails he was supplied with the various replies of Trade Me and www.homes.co.nz 
 
Well 5pm Wednesday has passed, and the reality is the letter from their lawyers was a rather puerile attempt to suppress the story. 
 
The lawyers claimed of all things defamation…. I wonder if they have heard of the defences of truth, or honest held opinion. 
 
Below is the list the of questions we put to David Subritzky and Richard Thode – 
 

Good afternoon Richard,

I note I am yet to receive a reply from you, so with that being the case would you be able to answer the following initial questions for me?

1. Did you request / obtain written permission from the Vendors (name redacted) or their Trustee to change the property details on homes.co.nz?

2. If so, when? (Please supply a copy of that permission)

3. Did you comply with the rules of the REAA when adjusting the property information on homes.co.nz?

4. Did the sale price fall inside the newly adjusted details at homes.co.nz?

5. Did you make the Vendors (name redacted) or their Trustee clearly aware of the above when selling the property?

If you can reply to me on or before 4pm tomorrow – Tuesday 8 July 2026.

As you can see that was back on 7 July, some 6 weeks ago, so both the agent, Richard Thode, and office Principal David Subritsky have had more then enough time to respond to our questions. 

Since that time we have been making further enquiries as to how the change of price occurred, and the emails we have been provided need to be answered by both Ray White Epsom, and Richard Thode. In our next article we will share those emails. 
 
We have also been talking with others in the real estate industry – their comments will be shared in an upcoming article.
