“Williams Corporation will formally pursue the Advertising Standards Authority for damages. Our lawyers are sending a letter today to begin that process.
Our position is that the ASA misrepresented its authority and led us to change our advertising when we were not legally required to follow its decisions. We believe that conduct was misleading, and we will seek to recover the costs we say resulted from it.
The ASA is a private organisation. It is not a government regulator. Its own correspondence confirms that compliance is voluntary. That distinction should be clear from the beginning, not something a business has to discover after dealing with official-looking demands.
I have no objection to someone questioning our advertising. We should be accountable for what we publish. But an organisation calling businesses misleading must meet that same standard itself.
We will put our evidence and claimed losses through the legal process. Liability and compensation will need to be determined, not simply asserted by either side.
Private organisations are entitled to express opinions. They should be equally willing to accept scrutiny and responsibility for how they conduct themselves”.
